Power of Attorney

This is the Continuing Power of Attorney for Property of me, Mr. John Peter Smith, of Toronto, Ontario, Canada.

Applicable Law

I make this Continuing Power of Attorney for Property according to the Substitute Decisions Act of Ontario.

Revocation of Previous Powers of Attorney

I revoke any Powers of Attorney for Property that I have previously given.

Appointment of Attorney(s)

I appoint my wife, Jane Smith, of Toronto, Ontario, as my true and lawful Attorney.

If my wife, Jane Smith, of Toronto, Ontario dies, or refuses, or is unable to act or continue to act, then I appoint my brother, James Smith, of Vancouver, British Columbia, to act as my true and lawful Attorney.

Any persons acting as my Attorney may renounce their appointment at any time before this Continuing Power of Attorney for Property comes into effect.

Powers to Endure

The powers I give my Attorney in this Continuing Power of Attorney for Property, are to continue and are not to be revoked notwithstanding any mental incapacity or infirmity on my part that occurs after the execution of the Power of Attorney.

I may revoke this Continuing Power of Attorney for Property at any time, in writing, as long as I have the capacity to do so.

Unless revoked by me during my lifetime, this Continuing Power of Attorney for Property terminates on my death.

Coming into Effect

This appointment enables my Attorney to act on my behalf and will come into effect only if I become mentally incapable of making reasonable judgments about my property. A written declaration from two medical doctors authorized to practice in Ontario is to be conclusive proof that I have become mentally incapable. If I am then outside of Ontario, then a declaration from two medical doctors licensed to practice in that jurisdiction is to be conclusive proof, instead.
